Zurich Higher Court Declares Judge Again to be Biased

The Zurich Higher Court has declared a judge of the Zurich District Court to be biased for the second time. He must therefore recuse himself from two proceedings against climate activists. The trigger was that he had apparently indicated when acquitting another activist that he would always decide in this way in the future. The Higher Court concluded in its decision that the judge could be biased. It therefore accepted the recusal requests of the public prosecutor for two proceedings against climate activists. This was already the second time that the Zurich Higher Court had to deal with the case. The Federal Court had sent back a first decision to the Higher Court because the accused climate activists had not been able to comment on the case. The Higher Court now made up for this and again concluded that the judge could be biased. As a result, the judge can no longer conduct the proceedings against two climate activists who blocked Uraniastrasse in Zurich on October 4, 2021, as planned. One of the proceedings was originally scheduled to take place in November of last year. After the "Republik" reported on an acquittal by this judge in a similar case, the public prosecutor applied to have him declared biased. Although the judge denied this statement, the public prosecutor and the "Republik" interpreted his statements as meaning that he would also acquit the accused in future climate proceedings.
