Prosecutor sees contingent intent in Andelfingen ZH accident

At the High Court of the Canton of Zurich, the public prosecutor declared on Friday that the accused had caused a fatal traffic accident on the A4 near Andelfingen ZH in November 2017 with intent. The court of first instance had found negligence.

In July 2021, the District Court of Andelfingen ZH found the Swiss national, who is now almost 26 years old, guilty of multiple counts of endangering life, involuntary manslaughter, involuntary grievous bodily harm and various traffic offenses. It sentenced him to five years and two months' imprisonment.

The defendant told the High Court that he wanted to reduce his sentence with his appeal. He had "already suffered enough punishment", as his best colleague had died in the accident. That was upsetting for him.

He made use of his right to refuse to testify when asked detailed questions about the course of the accident. He had never acknowledged that he had accepted the risk of a serious accident.

According to the public prosecutor, there can be no question of negligence. The accused lacked any sense of responsibility with his "mad ride", in which he wanted to overtake a semi-trailer truck on the A4 via a rest area, and showed "enormous indifference" towards his fellow human beings.

He had acted with intent: Although he had not wished for the outcome of the maneuver - one fatality, several people injured, some of them seriously - he had accepted it. A prison sentence of six years was appropriate.
