Acquittal of Climate Activists After Call for Civil Disobedience

The Federal Criminal Court acquitted three climate activists of the charge of inciting the violation of military duties. The Western Swiss had called on the internet to not perform military service or pay the replacement tax. The costs of the proceedings, amounting to 11,500 Swiss francs, will be imposed on the federal government. In addition, the three defendants will be compensated for their expenses incurred in the proceedings of over 38,000 Swiss francs. In May 2020, the defendants published an article on the Klimastreik website entitled "Ich boykottiere die Armee". In it, they called for ethical and moral reasons, as well as ecological and social responsibility, not to follow a call-up for military service and not to pay the military service replacement tax. They also published this call on the Telegram news service. One of the defendants was convicted by the Cantonal Court of Vaud in connection with his participation in four climate actions in Lausanne in 2019 and 2020 to a fine of 125 daily rates and a fine of 1000 Swiss francs. This decision is final. The judgment of the criminal court is not yet final and can be appealed to the Appellate Court of the Federal Criminal Court.
