Acquittal for an alleged ATM burglar overturned

The appeal proceedings against one of the alleged ATM burglars from Neftenbach ZH and Sevelen SG will be reopened. The Appeals Chamber of the Federal Criminal Court has approved an appeal by the Office of the Attorney General of Switzerland. The accused's crony has come clean in his own trial.

The crony remained silent for a long time, so that his Romanian colleague and compatriot was acquitted in the second instance due to a lack of evidence. But at the appeal hearing, he came clean. He gave the name of his colleague and that he had blown up the ATMs in Neftenbach and Sevelen together with him in December 2019.

At the request of the Office of the Attorney General, the Appeals Chamber of the Federal Criminal Court recognized these statements as grounds for appeal. It has overturned the Romanian's acquittal and will conduct new appeal proceedings, according to a decision published on Tuesday.

Danish criminal record

The Romanian, who has since been more forthcoming, was sentenced to 75 months' imprisonment in the second instance in March. The criminal division had also sentenced him to 64 months for multiple counts of endangering with explosives and toxic gases with criminal intent, multiple counts of qualified theft, multiple counts of qualified damage to property and trespassing.

The pre-trial detention served in Switzerland will not count towards the man's sentence, but towards a six-year prison sentence handed down in Denmark in June 2022. The man had also blown up an ATM there. (Decision CR.2023.15 of 21.5.2024)
