Bern High Court rules on rival murder

From Tuesday, the Bernese High Court will hear the case of a Brazilian man who was sentenced at first instance to over 18 years' imprisonment for the murder of a rival in 2022. The defendant is accused of killing his ex-wife's new boyfriend.

The accused then allegedly burned the body in a forest near Meikirch BE. In June 2022, the Regional Court of Bern-Mittelland, the court of first instance, even slightly exceeded the prosecution's proposals with its sentence. The defense had pleaded guilty to murder with intent

In the course of the investigation, the accused confessed to stabbing the victim with a knife. However, he stated that he had had to defend himself due to provocation.

The court of first instance did not believe the convicted man's statements. The presiding judge admitted that the accused had probably not planned the crime for a long time. However, there were numerous indications that he had worked towards a meeting alone with his ex-wife's new partner.

The momentous meeting took place in the convict's apartment in Bern-Bethlehem. The victim had come on business to inspect water damage.

The court assumed that the accused had stabbed the victim at least five times from behind. The accused then put a plastic bag over the victim's head and attached it to his neck with adhesive tape.

Overall, the court qualified the act as extremely selfish, cold-blooded and extraordinarily brutal. The threshold from premeditated murder to murder was not only just exceeded, the judge stated at the time.

The Bernese High Court will now hear the case in the second instance and is expected to announce its verdict on May 8.
