BGH rules acquittal for Holocaust denier

Karlsruhe (dpa) - The Federal Court of Justice will decide on Wednesday (11.00 a.m.) whether Holocaust denial in a letter to the tax office is to be punished as incitement to hatred. Specifically, the case concerns Sylvia Stolz from Ebersberg in Upper Bavaria, who has already served two prison sentences for incitement to hatred. In 2021, she sent a 339-page fax to the Munich tax office in which she denied the Holocaust in passages. The question in court was then: Is this a criminal offense? (Ref. 3 StR 32/24) The Munich II Regional Court found no - and acquitted Stolz. The public prosecutor's office appealed against the verdict, so that the matter became a case for the highest German criminal court in Karlsruhe.
