Federal Council to examine exchange of criminal record data with Italy

The Federal Council wants to examine whether the conclusion of a bilateral agreement between Switzerland and Italy on the exchange of criminal records data is possible and appropriate. It has requested the adoption of a corresponding postulate.

The review request comes from the National Council's Political Institutions Committee (SPK-N). The plenary still has to decide on it. The Federal Council recommends the motion for approval without further comment, as it announced on Thursday.

Thanks to the new law on the Vostra criminal records information system that recently came into force, it is now technically possible for Switzerland to join the EU's Ecris program. In the view of the Federal Council, this program would be an effective instrument for obtaining information in criminal proceedings or when issuing a residence permit in cases of particular suspicion.

According to the SPK-N, however, it is likely to be years before Italy joins Ecris. However, as it is of great importance for Switzerland to effectively fight against the Italian mafia gaining a foothold on its territory, the Commission wants to examine whether a bilateral agreement with Italy on the exchange of criminal record data is even possible.
