Jans: “Institutional framework that creates legal certainty”

In the view of Justice Minister Beat Jans, the newly proposed institutional framework creates legal certainty in relations with the EU. Switzerland could invoke the negotiated safeguard clause in the event of serious economic difficulties.

It is the common understanding of the contracting parties that Switzerland has the option to deviate from the free movement of persons in this case, said Jans on Friday in Bern in response to a question from a journalist. This would require specific criteria to be met, such as exceptional immigration or an increase in social welfare, an increase in unemployment or major problems within a sector - always due to immigration.

This point will also be fleshed out by domestic legislation. "This domestic legislation will help us vis-à-vis the EU," said Jans. Ultimately, this will then "of course be clarified in individual cases, if such cases arise".

Jans emphasized that this was a major step forward compared to the current situation. Because today there is no such framework.
