Multi-year prison sentence for shooting at a group of young people

The prison sentence of six years and two months for the "playground shooter" appears "rather lenient" to the Federal Supreme Court. It dismissed the man's appeal against the judgment of the Lucerne Cantonal Court in its entirety.
He had shot at a group of adolescents and young adults with an assault rifle for no good reason. It was generous in that the lower court had assumed slight to moderate culpability. This is what the Federal Supreme Court wrote in a ruling published on Wednesday.
In the summer of 2017, the now 40-year-old convict was annoyed by the noise of a group that was about 45 meters away on a playground. When two of the group urinated against a wall, the Swiss man picked up his assault rifle, inserted the magazine and took aim at the group. A young Kosovar was seriously injured by the shot.
Pressure bandage and schnapps
The facts summarized by the Federal Supreme Court show that the perpetrator had consumed 2.5 liters of beer when he fired the shot. After the shot, he put the gun away, sent a text message to his girlfriend saying "ech ha scheisse baut" and went to the victim with bandages, to whom he applied a pressure bandage. He instructed the bystanders to call the ambulance. The man then went home and had a drink.
The Federal Supreme Court follows the view of the cantonal court, according to which the offender was culpable despite being under the influence of alcohol. He was considerably under the influence of alcohol. Otherwise, he would not have been able to act so clearly after the shot.
The Federal Supreme Court did not hear the man's criticism of the sentencing and the facts of the case. The cantonal court considered the man's statement that it was an accident to be a protective assertion.
