Only a partial success for Judge Andrea Blum before the Federal Supreme Court

Judge Andrea Blum has achieved a partial success in the affair surrounding intrigues at the Federal Criminal Court. The Federal Supreme Court confirmed the rejection of the Appeals Chamber of the Federal Criminal Court as requested by Blum. However, it rejected her request to extend this measure to the Appeals Chamber.
In a ruling published on Wednesday, the Federal Supreme Court rejected the appeal lodged by Blum, Vice President of the Appeals Chamber of the Federal Criminal Court, against the decision of the Extraordinary Court of Appeal. At the end of November 2023, this ad hoc instance consisting of three cantonal judges had ordered all 14 ordinary and deputy judges of the Appeals Chamber to stand down.
However, it refused to extend this measure to seven judges of the Board of Appeal and the clerks of both chambers. The Federal Supreme Court came to the conclusion that it was not justified to go any further. Blum had not succeeded in establishing a sufficient connection between the two bodies to justify extending the suspension.
Years of dispute
This decision is part of the conflict between Blum and the Administrative Commission of the Federal Supreme Court. In July 2020, Blum filed a criminal complaint with the Office of the Attorney General of Switzerland (OAG) against members of the Administrative Committee (AC) of the Federal Supreme Court at the time. It concerned alleged defamation, possibly slander, false accusation, coercion and abuse of office.
This was triggered by the supervisory report of the Federal Supreme Court's Administrative Chamber on incidents at the Federal Criminal Court, in which Blum, among others, was mentioned by name. A short time later, disrespectful remarks about Blum made by the then President of the Federal Supreme Court were also made public.
