Parliament Decides on Comeback of Double Names

The National Council Commission has expressed support for a wide-ranging amendment to allow couples to take on double-barreled surnames upon marriage, which would also give children more flexibility. This amendment would reverse the 2013 decision to abolish double-barreled surnames.

On Friday, the Legal Commission of the National Council (RK-N) voted 14 to 10, with one abstention, to pass a resolution that the double surname for married couples should be reintroduced with more flexibility than in the old law, and should also be possible for children. The Parliament Services announced the news.

The consultation on the corresponding amendment to the law had opened doors. Parties and cantons generally prefer the proposed "grand solution". Criticism was directed at the exclusion of children's rights. The Legal Commission has now taken this criticism into account. The Parliament will now decide on this.

Couples or registered partners will now have the option to independently choose to take on a double-barrelled surname. Children will also be able to take on a double-barrelled surname composed of the names of both parents, should the parents wish it.

Married couples and those in a registered partnership, as well as the minor children of married and unmarried parents, have the opportunity to form a double surname according to the new law, based on the transitional law.

A minority has requested not to proceed with the proposal. Another minority has requested to refer the proposal back to the Commission with the mandate to revert to the old law prior to 2013. In the next step, the Commission will submit the adopted draft and report to the Federal Council for comment. The National Council is expected to discuss the proposal for the first time in the spring session of 2024.
