Prosecutor demands 14.5 years in prison for the main defendant

Eight people have had to answer to the Lucerne Criminal Court for a fatal altercation in Geuensee LU in 2021. The public prosecutor pleaded intentional homicide, the defense lawyer pleaded self-defense.
On the second day of the trial at the St. Martin Center in Hochdorf, the last two of the eight accused were questioned. This included the man who had withdrawn from the deal with the other side due to a difference of opinion.
When he claimed back the investment he had already made, he did not receive the full amount. He testified to the judges of the Lucerne criminal court that he had been defrauded. A trap was then set for him at the petrol station in Geuensee, where the parties wanted to meet to talk.
A fight broke out, with both parties claiming that the other party had started the attack. The interviewee is accused of hitting a man lying on the ground in the back of the head with his fist - presumably holding a key in his hand.
Death accepted
In his plea, the public prosecutor demanded a prison sentence of 14.5 years and a 15-year ban from the country for the main defendant, who was responsible for the death of one of the participants.
The victim was unarmed when the defendant stabbed him in the chest with a knife, according to the public prosecutor. The right ventricle was punctured, causing the heart to fail to pump. When the victim turned away, the accused stabbed him a second time in the back.
Even if it had not been the defendant's aim to kill the man, he had nevertheless accepted his death, according to the public prosecutor. He would also have injured another man by stabbing him in the back of the head, thus exposing him to a high risk of death.
For the younger brother of the main defendant, who had broken the skull of a participant with a wooden stick, he demanded a prison sentence of 5 years and a 10-year ban from the country. He had accepted a risk of death with the blow.
Conditional prison sentences of between 8 and 20 months were demanded for three of the accused. Three other defendants were to be fined due to their "supportive behavior" in the scuffle.
Defense lawyer pleads for self-defense
The defense lawyer for the main defendant pleaded self-defense. His client and his family had been attacked by the counter-group. He was only trying to protect his life and that of his family. According to the defense lawyer, the victim had hit the accused in the face with his fist immediately before the stabbing.
The defense lawyer accused the leader of the opposing party of having requested and paid four other people - including the murder victim - as reinforcements. A sum of 1,600 francs had been transferred to one of the participants after the crime. This underpinned the fact that the other party had already assumed a physical altercation before the meeting.
The leader of the other party also attacked the main defendant with a hammer, whereupon the latter defended himself again with the knife. This hit the back of the "leader's" head and caused a 15-centimeter-long severing of the scalp.
The defense lawyer demanded an acquittal and compensation of 159,000 francs for his client. The trial will continue on Friday, November 17.
