Prosecutor pleads murder before Bern High Court

On Thursday, the public prosecutor clearly described the violent attack on a young woman in Ostermundigen BE in August 2021 as murder before the Bernese High Court. He demanded confirmation of the corresponding first-instance verdict
The accused, in his mid-twenties, was sentenced in the first instance to 16 years imprisonment for murder.
The accused had indeed behaved particularly unscrupulously, said the public prosecutor in his plea on Thursday. He had needed a laptop for vocational school, which he had not been able to afford. He was financially up to his neck in debt. He had hoped to get both laptop and money from his acquaintance.
The two had got into an argument. The accused made no attempt to settle the dispute. Instead, his will to kill her was strong. Even if the act had not been planned in advance, it could still fulfill the characteristics of murder, the public prosecutor concluded.
After the victim's death, the accused transferred money to himself from the victim's cell phone via Twint and took the young woman's laptop. He used the money to pay off debts and then went shopping in Zurich with another crush. All of this is evidence of particular unscrupulousness and cold-bloodedness.
The accused had repeatedly adapted his statements to the status of the investigation. "An up and down", said the public prosecutor. The statements were not credible, the defendant had made protective allegations.
Under the coaching of his defense lawyer, the man confessed to killing the woman on Thursday, said the lawyer for the victim's parents. The confession had the sole aim of averting a conviction for murder.
The victim had to die because of a few hundred francs and a laptop. This was particularly reprehensible and unscrupulous. The crime fulfilled the characteristics of murder. He also called for the first-instance verdict to be confirmed.
