At the beginning of the trial against the former Thurgau cantonal veterinarian, the lawyer for the horse breeder from Hefenhofen called for the charges to be dismissed. This was incomplete and seriously flawed. The court is discussing the motion.
In an hour-long speech before his actual plea, the plaintiff's defense attorney asked the district court to dismiss the prosecution's indictment before the trial for supplementation and improvement. The court interrupted the trial and deliberated until eleven o'clock on the motion to dismiss the prosecution's indictment.
The lawyer argued that several accusations were missing from the indictment. For example, the sale of numerous animals after the "unlawful eviction" was not part of the indictment. His client would therefore lack the basis to claim damages.
In August 2017, the Thurgau authorities ordered the eviction of the farm in Hefenhofen and confiscated 90 horses, among other things. Prior to this, photos of severely neglected animals had circulated in the media. The horses were later auctioned off.
Accusations against cantonal veterinarian
Before the Frauenfeld District Court, the horse breeder's lawyer recalled the acquittal of the horse breeder in the first instance on charges of cruelty to animals. While his client had been dealt with harshly by the investigating authorities, the accused members of the authorities had been treated leniently.
According to the prosecution's indictment, the former head of the veterinary office is accused of failing to enforce animal welfare regulations. The charges range from abuse of office, favoritism and cruelty to animals to damage to creditors and fraudulent mismanagement, theft of property, theft and coercion.
