In future, it will be easier for temporarily admitted persons in Switzerland to move their place of residence to another canton if they work there. In addition, the federal government is lifting the permit requirement for self-employment or employment for persons with a hardship permit.
The corresponding amendments to the law and ordinances will come into force on June 1. This was announced by the Federal Council on Wednesday. According to the federal government, it must be specified that it is unreasonable to expect persons who are temporarily admitted to Switzerland to remain in their canton of residence.
According to the communiqué, this is the case if the journey to work is more than 90 minutes long, the place of work cannot be reached by public transport or is difficult to reach, or if work has to be carried out at short notice.
Another change from June 1 is that the obligation to register for gainful employment will be waived for temporarily admitted persons, refugees and stateless persons if this serves the purpose of professional integration or reintegration and the gross monthly salary does not exceed CHF 600.
Persons attending a program to prepare for basic vocational training are generally exempt from the obligation to register.
Freedom of movement for persons with protection status S
With the amendments to the law and ordinances, the Federal Council is implementing a parliamentary mandate from the end of 2021. According to the government, the revision of the Foreign Nationals and Integration Act passed by the Federal Assembly also included restrictions on travel abroad for temporarily admitted persons, asylum seekers and persons with S protection status.
The Federal Council decided to implement this part of the parliamentary mandate in a second step. It instructed the Federal Department of Justice and Police to draw up a dispatch to create a special regulation for persons with protection status S from Ukraine.
The reason for this is the first-time activation of protection status S by the Federal Council on March 11, 2022 and the simultaneous decision to grant freedom of travel for refugees from Ukraine.
