The expert appointed by the Zurich Higher Court to examine Brian's detention conditions criticized the justice system on Monday before the District Court of Dielsdorf ZH. The detention conditions had significantly exacerbated Brian's aggressive behavior.
Certain restrictions may be permissible, such as for the protection of other persons, said the expert. However, the institution in this case, Pöschwies Prison, must do "everything possible" to maintain standards. This has not been done adequately. Solitary confinement for three and a half years is prohibited under human rights law.
The court would have liked to have seen and heard Brian personally, as the judge said at the beginning. However, the 28-year-old did not want to be brought to court in handcuffs and shackles. Therefore, he was allowed to remain in Zurich prison.
Brian is facing charges for 30 offenses allegedly committed in Pöschwies prison. His lawyers argue that the harsh prison conditions were the cause of the attacks.
