Ticino judicial council removes two judges from office

The Ticino Judicial Council has dismissed two judges from the cantonal criminal court in Lugano with immediate effect. They had reported the president of the court for the criminal offense of pornography.

According to the press release issued by the Judicial Council on Thursday, the charges amounted to a "serious breach of their duties as magistrates".

The two judges had reported the court president, although they had known that this accusation was unfounded. Such a complaint against a colleague was unacceptable and incompatible with the office of a magistrate.

The president of the cantonal criminal court in Lugano was exonerated of the charge of pornography at the beginning of September. The Ticino government had appointed an extraordinary public prosecutor from the canton of Graubünden to investigate the criminal complaint.

The disciplinary penalty imposed is the most severe provided for by law. It was justified in view of the seriousness of the offense committed, the context in which the complaint was made, the consequences for the reputation of the cantonal criminal court and the entire judiciary, as well as the guilt of the two magistrates as determined by the Judicial Council.

Disciplinary proceedings are still underway against the President of the cantonal criminal court, Mauro Ermani, as stated in the press release The handling of the proceedings is "also a top priority" for the Judicial Council, but requires different investigations and therefore "different procedural times".
