Two-fifths more conciliation proceedings in the first half of 2023

In the first half of 2023, 42.2 percent more new rental or lease arbitration proceedings were opened than in the second half of 2022. The Federal Office for Housing (FHO) assumes that this was due to the increase in the key mortgage interest rate on June 2.
The number of conciliation proceedings initiated rose to 17,519 between January and the end of June, as reported by the BWO on Tuesday. This means that the number of new cases filed in the canton of Zurich more than doubled. These cases alone accounted for more than a quarter of new cases nationwide. There was a doubling in Lucerne, Uri and Schwyz, but a minimal decrease in Geneva.
Including new cases, the conciliation authorities dealt with 23,723 cases in the first half of the year. They concluded 13,395, 1709 more than in the last half of 2022. 56.2% of the parties reached a settlement, acknowledged the claim or withdrew it.
In 15.1% of cases, the opposing parties were unable to reach an agreement, which led to a claim being filed. 21.3 percent of cases were settled by withdrawal, non-admission, irrelevance or referral to an arbitration tribunal.
The most common reasons for settled proceedings in the semester under review were contract terminations (16.7%) and payment requests (14%). The proportion of rent disputes rose from 7.2% to 9.6% compared to the previous semester of 2022. And ancillary cost proceedings grew from 3.2 to 4 percent.
