The Federal Council is Examining the Competence of the Federal Prosecutor’s Office for Terrorism

The Swiss Federal Council has released a report on the division of competencies between cantons and the federal government in criminal prosecution. The report states that the current division of competencies has generally been successful, but that certain adjustments may be necessary to increase efficiency, particularly in the prosecution of terrorist offences. The Federal Council is considering making the Federal Prosecutor's Office responsible for all terrorist offences, as these cases often involve international elements and have a political dimension. The Federal Council is also looking into ways to speed up the process of determining which authority is responsible for a particular case, such as by introducing rules or issuing recommendations from the Swiss Prosecutors' Conference. However, the Federal Council has rejected the idea of creating a separate body to make binding decisions on which authority is responsible for a particular case, as the difficulties in creating such a body would outweigh the expected benefits.
