On Monday, the judges of the Lucerne Criminal Court questioned six of the eight people involved in a fatal fight that took place in Geuensee. Both sides stated that they had been attacked by the other side and had only defended themselves.
The interviewees - three brothers - stated that they had wanted to help their sister move house. That is why they had driven from Basel to Lucerne on the day of the crime in 2021. The three brothers had wanted to meet their sister, her husband and son at a petrol station in Geuensee and then drive together to the other sister's apartment.
There they were attacked by men they did not know at the time. They defended themselves with a knife, a hose and a wooden stick. The objects were already in the vehicle. They were the brother's work tools.
The main defendant denied killing a man with a stab to the heart and injuring another with a knife to the back of the head. His brother also denied having broken a man's skull with a wooden stick. The third brother also denied threatening the men with a hose.
A prison sentence of 14.5 years with a 15-year ban from the country is demanded for the main defendant, a sentence of 5 years and a 10-year ban from the country for the second brother and a conditional prison sentence of eight months for the third brother.
The sister of the three brothers, their brother-in-law and their son also received a penalty order from the criminal and civil prosecutors. They are also alleged to have taken part in the brawl. They are being asked to pay fines.
Victim was unarmed
The other side - the accused are two brothers - also deny that they were the first to get out of the car that day. They only got out when they heard the "car doors" opening and closing again. They had wanted to protect their side and also only wanted to defend themselves.
The accused, who later suffered a fractured skull, is said to have attacked another man with a meat mallet. He is facing a conditional prison sentence of 10.5 months. He is also alleged to have asked four other people to accompany him to the meeting in Geuensee as a "security measure".
Among the four people who arrived at the scene at the petrol station a little later was the unarmed victim.
A conditional prison sentence of 13.5 months is demanded for his younger brother. Wearing brass knuckles, he is alleged to have struck a man in the head, possibly causing him life-threatening injuries.
Dispute over ventilation
The cause of the dispute was a failed business relationship. The brother-in-law of the man accused of murder had wanted to take over a bar in Triengen LU with a colleague - one of the injured. Due to differences of opinion, the brother-in-law withdrew from the business.
He was reimbursed 18,000 of the total 24,000 francs invested. His brother-in-law agreed, but his wife did not. She demanded that at least the ventilation system they had bought be removed, but the other party refused.
In the late afternoon, the four of them finally agreed to meet at a petrol station. Both sides brought reinforcements. While the four people were discussing behind the petrol station, the situation escalated in the parking lot in front.
Monday was the first of four trial days. The second day of the trial will take place on Thursday (November 16).
