Foreign nationals who have been convicted of hate speech as defined by the anti-racism penal code should have to leave Switzerland. This is what a narrow majority of the responsible committee of the Council of States wants.
The Legal Affairs Committee of the Council of States (RK-S) approved a parliamentary initiative with this demand by 3 votes to 3 and with a casting vote by President Daniel Jositsch (SP/ZH). It had been submitted by the Legal Affairs Committee of the National Council.
Now that the Council of States committee has voted in favor, the National Council committee can draft a bill. The initiative demands that all foreign nationals guilty of incitement to hatred under Article 261bis of the Swiss Criminal Code be automatically expelled from the country. The National Council's RK passed it by 13 votes to 5, with 4 abstentions.
