Sentence of 13 years for murder and desecration of corpse confirmed

The Federal Supreme Court has confirmed the conviction of a 40-year-old man by the Zurich High Court for intentional homicide and disturbing the peace of the dead. The man strangled his lodger and then assaulted her corpse. The prison sentence of 13 years is now final.
The convicted man has already served part of his sentence. He was arrested in September 2016 - one day after the crime - and has been in pre-trial detention or preventive detention ever since.
In a ruling published on Tuesday, the Federal Supreme Court rejected all of the 40-year-old's complaints. Among other things, he requested that he be sentenced for manslaughter and not for intentional homicide. He had acted in the heat of passion.
However, the court does not consider the elements for manslaughter to be fulfilled. The relationship between the complainant and the victim had been strained by disputes for some time. The two had also had an argument on the day of the crime.
Long procedure
The 40-year-old had let his anger get the better of him, even though he was more or less in control of the situation and had been able to let go of the victim. His behavior did not correspond to the emotions of an average person in a comparable situation.
The convict put one arm around the subtenant's neck and squeezed until she stopped moving. He then had his way with her body and then dressed her again.
The lengthy proceedings came about because the man was found not guilty of the homicide, but not of the desecration of a corpse. In its first ruling on this case, the Federal Supreme Court referred the matter back to the public prosecutor's office. (Judgement 6B_591/2024 of 14.11.2024)
