The Bernese High Court found a 58-year-old man guilty of murder on Wednesday. He had killed his ex-wife's new boyfriend at the beginning of February 2020. The High Court confirmed the sentence of over 18 years handed down at first instance.
The Brazilian-born man had admitted to killing the victim in his apartment in Bern-Bethlehem. His ex-wife's new boyfriend had provoked him and the argument got out of hand. He felt threatened by the man and stabbed him with a knife.
Like the first instance court, the High Court did not believe this version of the crime. There could be no question of provocation by the victim. The accused had not stabbed his rival in an argument, but simply stabbed him in the back. The perpetrator had acted absolutely rationally.
The High Court confirmed the custodial sentence of 18 years and three months handed down by the court of first instance and the 15-year ban from the country.
