Parliament restricts association complaints in residential construction projects

In future, associations will no longer be allowed to lodge complaints against smaller residential construction projects in the building zone. On Monday, the National Council resolved the final differences with the Council of States regarding the exemption provisions for complaints within water areas. The matter is therefore ready for the final vote.

In the first week of the session, the Council of States adopted more restrictive provisions than the National Council had envisaged in order to continue to allow association complaints against small construction projects.

The small chamber only wanted to allow complaints by associations if construction is to take place within an area of a site of "national importance". The Council of States deleted an exception for complaints against smaller construction projects within the water space - for example along streams.

In the draft of the National Council's Committee for the Environment, Spatial Planning and Energy (Urek-N), the right of appeal for associations was originally intended for "significant sites" and for construction projects within the water area. However, the majority of the Urek-N was willing to compromise and spoke out in favor of the small chamber's version.

With an individual motion, National Councillor Martina Munz (SP/SH) demanded in the Council on Monday that the right of appeal should only be lifted for residential buildings that only protrude slightly into the watercourse area. However, the motion was defeated in the Council vote by 118 votes to 72.

The corresponding amendment to the Nature and Cultural Heritage Protection Act (NCHA) was initiated by Valais National Councillor Philipp Matthias Bregy (center) with a parliamentary initiative. Before Monday, it had already been decided that complaints from associations under the NCHA would no longer be possible in future for residential construction projects if the floor area is less than 400 square meters and the project is located in a building zone.
