Prison sentence of 17 years confirmed for murder of girlfriend

The 17-year prison sentence for a Polish man and the subsequent 15-year expulsion from the country are legally binding. The Federal Supreme Court dismissed the man's appeal. He had beaten his girlfriend to such an extent that she died in hospital the following day.
Before the Federal Supreme Court, the man argued that the numerous injuries were caused by several falls due to his girlfriend's drunkenness and subsequently by the resuscitation attempts of the emergency services. However, the highest Swiss court did not follow his arguments in a ruling published on Thursday.
On the basis of several expert opinions and supplementary reports commissioned from two forensic medicine institutes, the Zurich High Court has already established that the man attacked his partner with fists and kicks.
Clear external influence
Even if it cannot be ruled out that the efforts of the emergency doctors led to a few rib fractures, the extent of the injuries clearly points to an external influence.
The lower court considered it completely unrealistic that the drunk victim fell and got up again several times, causing serious injuries to both sides of his head, face, entire chest and extremities.
The Federal Supreme Court follows this view. It also took into account the opinions of several specialists, including the forensic pathologist who examined the still-living victim when he was admitted to hospital.
The crime took place on March 3, 2020, when the convicted man called 911 at his partner's home in the early evening. The paramedics found the woman heavily intoxicated and with numerous injuries. She was resuscitated and taken to hospital. She died the next day. (Judgment 6B_88/2024 of 9.4.2024)
