The furniture retailer Conforama Switzerland did not deliberately deceive its customers with false discounts. The Vaud cantonal court has acquitted the company of the charge of unfair competition.
The company gets off with a fine of 5,000 francs. The public prosecutor's office and the French-speaking Swiss consumer protection organization (FRC) had demanded a fine of 1.5 million francs.
On the other hand, Conforama Switzerland must pay a compensation claim of 1.5 million Swiss francs. The court came to the conclusion that the use of false "crossed-out prices", which were intended to show the price of an item before the discount, led to unlawful profits, although this was not done intentionally.
With this sentence, the cantonal court on Monday confirmed the first-instance judgment handed down by the District Court of Lausanne in June 2023.
