Four years in prison and deportation for kidnapper

The Federal Supreme Court has confirmed a four-year prison sentence for a woman from Kosovo. She will also be deported from the country for seven years. In March 2019, the Kosovan woman and three other women abducted a fellow countrywoman. They sexually tortured and coerced her and released her after eight hours.

The complainant is the mother of a girl of primary school age. She took part in the crime, which is classified as a qualified abduction, although she did not know the victim. The victim had previously filed a risk report against one of the kidnappers with the child and adult protection authorities, as was revealed in a ruling published by the Federal Supreme Court on Friday.

The Kosovan woman applied for an extensive acquittal and a waiver of deportation. However, the Federal Supreme Court upheld the decision of the Zurich High Court in March 2022, which convicted the woman of multiple counts of joint sexual assault, deprivation of liberty, multiple counts of violation of confidential or private areas by recording devices, damage to property and theft of property in addition to the kidnapping.

Expulsion from the country permissible

The Federal Supreme Court considers the expulsion to be necessary. The woman had committed two so-called catalogued offenses that would require her to be expelled from the country - kidnapping and qualified sexual assault. She is neither socially nor economically integrated in Switzerland, lives on social welfare and has debts.

In addition, she had a criminal record for simple assault, multiple insults and threats. She could therefore hardly be given a positive prognosis. In the case of the abduction, she should not be regarded as a follower, but as the driving force. With her ideas for abusing the victim, she had given the crime a new dimension.
