The Federal Council must consider tougher action against unfair, untrue or defamatory reviews on internet platforms. On Monday, the Council of States deemed the options in the current law against unfair competition to be insufficient.
It approved a postulate from its Council member Fabio Regazzi (center/TI) by 25 votes to 10 against the Federal Council's proposal. The President of the Swiss Trade Association (SGV) argued that anonymity on the internet encourages hatred, resentment and unfairness.
He conceded that the current law allows the prosecution of such comments on rating platforms. However, this takes far too long. State action is called for. Damage caused by unfair reviews must be prevented.
Esther Friedli (SVP/SG) agreed with him. Unfair, untrue, misleading or defamatory reviews were commonplace, especially in the hospitality industry. Platforms often turned a deaf ear to complaints. Existences could be destroyed anonymously without being held accountable.
Economics Minister and Federal Councillor Guy Parmelin referred unsuccessfully to the law against unfair competition. Violations could already be punished with imprisonment or fines if reported. Civil actions are also possible, and ultimately the platform operators can be brought to justice.
