Basel rapist faces higher sentence

A Portuguese man who raped a woman in front of her apartment in Basel in 2020 together with a teenager is facing a higher sentence. The Federal Supreme Court is of the opinion that the culpability of the accused as an accomplice should be given greater consideration.

The Federal Supreme Court has overturned the ruling of the Basel-Stadt Court of Appeal in the Elsässerstrasse rape case, as it decided in a ruling published on Wednesday. The Basel judges must now rule on the case again.

At first instance, the criminal court in Basel sentenced the now 35-year-old to an unconditional prison sentence of 51 months and an eight-year ban from the country. In August 2021, the Court of Appeal mitigated the sentence of the lower court and sentenced him to 36 months' imprisonment, 18 months of which were unconditional.

The offender was therefore released from prison shortly after the verdict. The mitigated judgment of the Court of Appeal triggered a storm of indignation in Switzerland.
