Climate seniors want to report Switzerland to the Council of Europe if necessary

On Wednesday, the climate seniors sharply criticized the Legal Affairs Committee of the Council of States. The ruling of the European Court of Human Rights is binding for Switzerland and must not be ignored. If necessary, the Council of Europe will be informed.

"We expect the Federal Council to consistently protect the institutions and the rule of law and not to follow any declaration by the Council of States," said Rosmarie Wydler-Wälti, Co-President of the Climate Seniors, to the media.

The climate seniors demand that Parliament "fulfill its responsibility". If this does not happen, the climate seniors want to involve the Committee of Ministers of the Council of Europe and inform it of "any developments and omissions in Switzerland".

The Committee of Ministers of the Council of Europe has the task of reviewing the implementation of judgments of the European Court of Human Rights (ECtHR).

Law Commission wants to ignore ruling

This announcement was triggered by a decision by the Legal Affairs Committee of the Council of States on May 21. It came to the conclusion that the ECtHR had "inadmissibly overstretched the law" with its climate ruling.

The Commission requested that a declaration be issued stating that Switzerland sees no reason to comply with the ruling. The Council of States will decide on the adoption of this declaration in the summer session.

At the beginning of April, the ECtHR ruled in favor of the association Klimaseniorinnen and found that Switzerland had violated the Convention on Human Rights. Switzerland had not fulfilled its duties in terms of climate protection.
