Criminal investigation against the head of the Graubünden migration office

The Graubünden public prosecutor's office is conducting a criminal investigation into the head of the Graubünden Office for Migration and Civil Law for abuse of office. This was triggered by a criminal complaint about a residence permit that was not issued.

This was stated by the public prosecutor's office on Friday at the request of the Keystone-SDA news agency. It confirmed a report by Radiotelevisione Svizzera (RSI) on Thursday evening. The public prosecutor's office did not provide any further information on the investigation.

As the Graubünden Department of Justice, Security and Health (DJSG), to which the migration office belongs, explained to Keystone-SDA, the case concerns a single type B residence permit. According to court documents, the office demanded financial guarantees from a third party for an unemployed German woman who had applied for the residence permit.

One man wanted to provide the guarantees for the German woman indefinitely, but with a six-month notice period. However, the migration office demanded fixed guarantees until the woman took up gainful employment or left Switzerland. The man was not prepared to do this. The office then refused the residence permit.

Federal court rules in favor of woman

The woman fought this up to the Federal Supreme Court and was proved right. In its ruling last May, the Federal Supreme Court ordered the Migration Office to grant her a residence permit. Despite the lack of an unlimited guarantee, the man's financial guarantee was not of a temporary nature and was therefore sufficient, the court ruled.

At the same time, the guarantor, as the woman's legal representative, has filed a criminal complaint against the head of the department, explained the DJSG media office. The department does not comment on the ongoing proceedings. The Department and the Migration Office have taken note of the Federal Supreme Court ruling, it said.
