An alpine law expert takes a critical view of the charges in connection with the Bondo GR landslide. Rahel Müller told Saturday's edition of the Tages-Anzeiger newspaper that anyone who is out and about in the mountains is acting on their own responsibility.
Müller explained that special circumstances are required for third parties to be legally responsible. In the Bondo case, it would have to be examined whether those responsible were aware of the rockfall risk. The expert is skeptical that hiking trails would be closed at any risk. "Then we can no longer go into the mountains," Müller is quoted as saying in the Tages-Anzeiger.
The public prosecutor's office in Graubünden only filed the charges after a subsequent expert opinion. Relatives of the victims of the landslide had previously appealed to the Federal Supreme Court against the closure of the investigation. The expert opinion speaks of "numerous harbingers" that would have heralded the disaster.
Five people have been charged, including employees of the Grisons Office for Forests and Natural Hazards (AWN) and the incumbent National Councillor Anna Giacometti (FDP), then mayor of Bondo. Eight people died on August 23, 2017.
