Federal Court to undergo a “minor revision”

The Federal Council wants to resume the undisputed points from the failed revision of the Federal Supreme Court Act and implement them quickly. These include editorial and organizational issues. The controversial reduction of the court's caseload in minor cases will not be pursued further.
The Federal Department of Justice and Police (FDJP) is to draw up a consultation draft by the end of 2024. This was decided by the Federal Council on Wednesday. It calls it a "minor revision of the Federal Supreme Court Act".
A planned comprehensive revision to amend the Federal Supreme Court Act (BGG) failed in 2020: Parliament rejected the Federal Council's proposals. On the basis of an evaluation, the Federal Council had shown that Switzerland's highest court was overburdened and suggested, among other things, that the court should be relieved of the burden of minor cases.
This most controversial point will also not be pursued in the new draft. On the other hand, undisputed aspects that "continue to make sense and are politically acceptable to the majority" are to be reintroduced, as stated in the communication. These are changes of an editorial, legal or organizational nature. They concern, for example, the chairmanship of the division, the composition of the court or the notification of criminal convictions to victims of crime.
