Nidwalden dispenses with automatic vehicle searches for the time being

The canton of Nidwalden is dispensing with automatic vehicle searches for the time being. On Wednesday, the cantonal parliament removed this passage and other provisions from the partial revision of the police law without replacement.
This was prompted by a federal court ruling on the Lucerne Police Act. The court declared several provisions of the law, including those relating to automated vehicle searches, to be inadmissible.
In the first reading of the Police Act and before the Federal Supreme Court ruling, the Nidwalden cantonal council had adopted provisions that correspond to those of the canton of Lucerne. However, following the ruling of the Federal Supreme Court, these could not be adopted in their current form, explained the cantonal government.
Justice and Security Director Karin Kayser-Frutschi (center) therefore requested the deletion of the criticized articles. The cantonal government wants to amend them as quickly as possible.
This approach was undisputed in the Landrat. Parliament approved the government's proposal by 57 votes to 0. It then approved the partial revision of the Police Act after the second reading by 46 votes to 11.
The automated search records passing vehicles, including their license plates and occupants. Almost simultaneously, a comparison is made with the search registers.
The Federal Supreme Court argued that such a system, which primarily serves the purpose of criminal prosecution, encroaches on the powers of the federal government. Such surveillance measures would require a basis in the Federal Code of Criminal Procedure.
