Obergericht AG : Changement de stratégie avec un nouvel avocat de la défense

In the murder trial before the Aargau High Court on Thursday, the accused's new defense lawyer demanded new expert reports. He said that there was a possibility that his client was completely incapable of guilt due to medication.

As a sign of insight and remorse, his client no longer opposes the civil claims of the victims' survivors, said the defense lawyer. The 56-year-old Swiss man can no longer remember the crime. He also has little memory of the night before the crime.

In the first-instance hearing in April 2023 at Baden District Court, the defense lawyer at the time had pleaded self-defense and thus acquittal. The court had sentenced the man to 15 years' imprisonment. The public prosecutor, who had demanded 17 years, accepted the sentence.

The defense appealed to the higher court. This means that the so-called prohibition of aggravation applies in the second instance: the sentence may not be harsher.
