Parliament wants to extend deadline for reporting construction defects

In future, anyone buying or building a new home will have more time to report construction defects. Following the National Council, the Council of States has also approved a corresponding revision of the law on sales and work contracts. However, there are still significant differences.
The resolutions of the National Council, which wants to dispense with the complaint periods and instead provide for a duty to mitigate damages during a limitation period doubled to ten years, clearly went too far for the small chamber. On Wednesday, it decided to follow the Federal Council's model and generally provide for a period of sixty days for lodging complaints.
For the majority, the abolition of the complaint deadlines would lead to considerable legal uncertainty, which in practice would be associated with difficulties under the law of evidence, as committee spokesperson Matthias Michel (FDP/ZG) explained. A minority led by Brigitte Häberli-Koller (center/TG) countered that this system has long been established in neighboring countries - without any problems.
The bill now goes back to the National Council.
