Insufficiently substantiated verdicts against climate activists overturned

The Vaud cantonal court has given insufficient reasons for the convictions of three climate activists. The Federal Supreme Court has therefore overturned the decisions and sent them back.
In the three judgments, the lower court did not, or barely, specify the individual acts for which the three activists were convicted. In doing so, the cantonal court violated the right to a fair hearing, as the Federal Supreme Court stated in the rulings published on Thursday.
In its comments, it also points out that the cantonal court appears to acquit the defendants with regard to certain administrative offenses, at least in its statements, but that the opposite is stated in the dispositive. On this point, too, the lower court must go back to the books.
The three climate activists took part in demonstrations in Lausanne in September 2019. During the first action, they blocked a bridge so that traffic could no longer circulate. (Judgments 6B_40/2023, 6B_41/2023 and 6B_42/2023 of 8.1.2024)
