Bremgarten: Mother’s defense lawyer pleads manslaughter

At the District Court of Bremgarten AG on Tuesday, the mother's defense lawyer pleaded for his client to be convicted of manslaughter. His client had acted under great emotional stress.
Classifying the crime as murder would be wrong, said the defense lawyer. His client had acted under great emotional stress that had been building up for years. This constituted manslaughter - as well as an attempt in the fall of 2019. A partial prison sentence of three years was appropriate.
The defense lawyer said that the accused, who are from Germany, should not be expelled from the country. He referred to the Agreement on the Free Movement of Persons between Germany and Switzerland. One condition for deportation would be a serious threat to society in Switzerland. This was not the case.
The defense lawyer said that no one denied that the life of his client's three-year-old severely disabled daughter had been taken in Hägglingen AG in 2020. It was quickly clear to the public prosecutor: An overwhelmed mother had wanted to get rid of her child and had murdered her - together with her partner - in cold blood.
Biased accuser
The defense lawyer accused the prosecutor of a biased, one-sided investigation. In her summation, she had cherry-picked the evidence that would fit her theory. Significantly, she had not quoted any statements from the child's doctors, among other things.
According to them, it was clear that the girl would be dependent on round-the-clock care for the rest of her life due to her severe cerebral disabilities.
The chats and wiretap logs listed were also one-sided. It is clear that parents sometimes become abusive in an exceptional situation. There is also evidence of calm, objective conversations.
The lawyer confirmed the statements that the 32-year-old mother had made in court on Monday: that she and the child's father "wanted to save her" in view of her daughter's suffering. They had by no means wanted to get rid of the child - that would have been easy: They would have had a feeding tube inserted and handed her over to an institution.
