National Council Eases the Destruction of Piracy Products

The Swiss National Council has approved a proposal from the Federal Council to introduce a simplified procedure for the destruction of small shipments of counterfeit goods. This is in response to the increasing number of fake products being seized at the borders due to online trading. The new law will make it easier to destroy these pirated products, as 90% of them are found in small shipments of three items or less. The Federal Customs Administration, which is currently at its capacity limit, will benefit from the simplified procedure. The Institute for Intellectual Property will be responsible for both the simplified and the ordinary procedure. The aim is to reduce the administrative burden for both the customs authorities and the rights holders. The rights of the buyers will not be restricted, as they can still oppose the destruction and request a judicial review. To avoid the risk of damage if the destruction is later found to be unjustified, the destruction should take place no earlier than three months after the notification of the retained goods. The import of goods that violate intellectual property rights will remain unpunished. The proposal will now be sent to the Council of States.
