Lucerne court sentences six people involved in fatal dispute

The Lucerne Criminal Court has found the man who killed an opponent in a brawl at a petrol station in Geuensee LU guilty. Five other defendants were convicted of brawling. Two people were acquitted.

The main defendant was found guilty of possible intentional homicide and attempted possible intentional homicide, as the judges of the criminal court announced at the sentencing hearing on Monday afternoon. For the killing of the 20-year-old victim, the court handed down a prison sentence of 14 years and 4 months as well as a 15-year ban from the country.

According to the judges, the main accused had stabbed those involved with the knife in cold blood and in a targeted manner. Although the accused was initially in a defensive position, he later switched to attack mode.

The defendant must also pay compensation to the private plaintiffs on behalf of the victim's family, as well as damages and various sums of satisfaction to individual family members.

Two people acquitted

The younger brother of the main defendant was found guilty of attempted grievous bodily harm. He received a prison sentence of 2 years and 10 months, 12 of which must be served without fail, as well as a 10-year ban from the country. According to the indictment, he broke the skull of one of the participants with a wooden stick.

According to the medical report, however, the fracture was caused by a sharp-edged object, said the judge. There were doubts as to whether it was caused by the stick or by a knife handle. Nevertheless, the accused had accepted serious bodily injury. The main defendant and his younger brother have already lodged an appeal.

The nephew of the two brothers received a conditional prison sentence of 16 months. He had taken part in the scuffle with a hose.

The brother-in-law of the two brothers - one of the instigators of the dispute over a bar in Triengen - was found guilty of brawling and fined. His wife and son were acquitted of the charges.

One of the other parties, who had attacked several people with a meat mallet, received a prison sentence of 21 months, eight months of which must be served. He was also one of the perpetrators of the dispute at the Trienger Bar.

His younger brother received a 10-month conditional sentence. He is said to have hit a person with a knuckleduster, although it could not be proven whether he was actually wearing it.

Dispute escalated

The cause of the physical altercation in Geuensee was a failed business relationship. The brother-in-law of the main accused had wanted to take over a bar in Triengen LU with one of the people involved in the brawl. Due to differences of opinion, the brother-in-law withdrew from the business.

Instead of the 24,000 francs invested, he was only reimbursed 18,000 francs. His brother-in-law agreed, but his wife did not. An argument ensued, which was supposed to be resolved later at the petrol station in Geuensee. Instead, the situation escalated. Several people were seriously injured in the physical altercation and one man was killed.
