Swiss Volkswagen Customer Wins in Diesel Scandal Court Case

A Swiss owner of a VW diesel car has once again been successful in court. The Geneva Court of Appeal confirmed the conviction of an Amag importer. The Amag criticised the expert opinion and did not rule out taking the case to the Federal Court. The lawyer of the plaintiff, who had purchased a vehicle with a manipulated engine, made the June ruling public on Thursday evening. The court therefore holds the view that the customer was in the right when he rescinded his purchase contract. The case has high symbolic value as it was the first ruling in Switzerland in favour of a customer. Despite the recall by the Amag, the vehicle was still environmentally harmful according to the applicable standards. The driver could have been fined if he had been driving the car. As a result, the Amag was sentenced at the end of 2021 in the first instance to take back the vehicle and pay the victim 18,000 francs - in addition to the estimated court and legal costs. The lawyer had repeatedly asked Volkswagen and the importer to compensate all its customers - more than six years after the Dieselgate scandal. In a statement released by RTS on Thursday, the Amag criticised an "incorrect legal opinion". The importer did not rule out taking the case to the Federal Court. In the emissions scandal, VW manipulated diesel vehicles on a large scale so that they emitted low levels of pollutants in official tests, but were significantly more environmentally harmful in normal use. It is estimated that around 175,000 car buyers and leasing customers in Switzerland were affected by the manipulations.nnnn
