Accomplice in robbery of cash-in-transit convicted by final judgment

An accomplice in the robbery of a cash transport in Chavornay VD in 2018 has been finally sentenced to five and a half years' imprisonment. The Federal Supreme Court only upheld the man's appeal on the issue of compensation for the loot taken.
In March 2023, the cantonal court of Vaud convicted the now 33-year-old of attempted and aggravated robbery. In a ruling published on Friday, the Federal Supreme Court confirmed that the man had acted as an accomplice and not as an accessory. He had made significant contributions to the crime.
However, the highest Swiss court has upheld one of the man's complaints. He is therefore not jointly and severally liable with another man convicted in Switzerland for the compensation claim of around CHF 25 million.
According to the Federal Supreme Court, joint and several liability is permissible under civil law in the case of a claim for damages. However, the Criminal Code does not provide for this in the case of claims for compensation.
The claim must be divided among the parties involved. It should be taken into account that the perpetrators of the robbery were not only on trial in Switzerland. They had agreed on the division of the loot. The case will therefore be returned to the cantonal court for a reassessment.
Wrong transport robbed
The convicted man was part of a group from Switzerland and France that planned to rob a cash-in-transit company. The idea for the robbery came from an employee of the cash-in-transit company to be robbed. Among other things, the convicted man acted as a conduit for information between two of the men involved.
A first robbery attempt in January 2017 failed. The three men from France who were supposed to commit the robbery held up the "wrong" cash van. There were two uninvolved employees in the van, who managed to put the robbers to flight. A few minutes later, the idea provider for the robbery arrived on site with his transport.
During the second attempt in February 2018, two men in France kidnapped the daughter of one of the idea giver's work colleagues. The two went on a tour together that day. The colleague was called by phone and given instructions. This time the robbery succeeded. 25 million francs were stolen. So far, only 2.5 million have been recovered.
