Claiming Defects Should Be Allowed for a Longer Period of Time

The Swiss National Council has voted in favour of a proposal to extend the time period for reporting building defects. Currently, defects must be reported immediately, otherwise the right to claim for damages is forfeited. The new proposal would allow defects to be reported within a period of limitation, giving the buyer or builder more time to report any issues. The Council went further than the Federal Council, who had proposed a 60 day period, by allowing an unlimited period of time for reporting. However, the Council also stipulated that the buyer or builder must still take steps to minimise any damage. The proposal also extends the period of limitation for buying land or building a property from five to ten years. This would also apply to any fixtures and fittings. The proposal will now go to the Council of States for consideration.
