Council of States committee opposes anti-sexism legislation

Incitement to hatred and violence based on gender should not be punishable. The responsible committee of the Council of States maintains this opinion. It is therefore proposing a "no" to six identical initiatives adopted by the National Council.

The Legal Affairs Committee of the Council of States (RK-S) made the decision by 6 votes to 3, as announced by the parliamentary services on Tuesday. Next, the Council of States will deal with the six initiatives from the SP, Greens, GLP, Center, FDP and EVP. The National Council supported these at the end of 2023.

The National Council thus endorsed the addition of the word "gender" to Article 261bis of the Criminal Code, the so-called anti-racism criminal provision. Violations of this provision would be punishable by up to three years' imprisonment or a fine.

The RK-S rejected the proposal for the second time. According to the press release, the majority was of the opinion that gender should not be included in the list of grounds provided for in the criminal law against discrimination.
