Lesbian organization welcomes penalty order against waitress in Baden AG

The Swiss lesbian organization LOS and the gay association Pink Cross have welcomed a penalty order for discrimination against an employee of a bar in Baden AG. She had expelled a lesbian couple from the bar in January 2023.

"What happened in Baden is not a question of freedom of expression, but discrimination against a lesbian couple, which is punishable by law," LOS co-director Alessandra Widmer was quoted as saying in a statement on Sunday.

In times of growing resentment against the LGBTIQA+ community, it is important that the media, politicians and the state take a stand and support those affected and their rights, said Widmer. The abbreviation stands for lesbian, gay, bisexual, transgender, intersex, queer, asexual and others.

At the end of February, the Baden public prosecutor's office sentenced the waitress to a fine of CHF 400 and a conditional fine of 30 daily rates of CHF 70 each for discrimination. She must also pay the legal costs of the women concerned.

The lesbian couple had been talking to each other in the bar, holding hands and kissing. The waitress finally gave the couple back the money they had already paid for their drinks and asked them to leave. According to media reports, the landlord said that the couple had behaved in an offensive manner.
