National Council wants to facilitate online surveys

The National Council wants foreign civil courts to be able to hear or question people in Switzerland by telephone or video link in future without the authorities' permission. The Grand Chamber adopted the corresponding amendments to the law on Wednesday.

The large chamber reached its decision by 123 votes to 65, with no abstentions. The SVP parliamentary group voted against. The Council of States must now deal with the matter.

With this proposal, the Federal Council is implementing a mandate from Parliament. Proponents consider the current regulation with individual case approval to be too cumbersome in view of the advancing digitalization. Swiss litigants have an interest in low hurdles.

It is envisaged that such interviews must continue to be reported to the authorities. The competent cantonal court must be able to listen to the telephone or video conference on request.

As before, interviews should only be conducted with the consent of the person concerned. They have the right to be questioned in their native language.

The majority of the preliminary committee was in favor of the legislative amendments. A minority of the SVP requested that the bill not be passed, as they feared a loss of sovereignty for Switzerland.
