The Council of States Against Humanitarian Action for Long-Term Emergency Assistance Recipients

The Swiss Council of States has rejected a motion to grant a second chance at a regular residence permit to people relying on emergency aid from old asylum procedures. The small chamber adopted the opinion of the consulting commission, which found that it would be legally questionable and violate the principle of equality if Switzerland granted a residence permit to a certain group of people. The motion was submitted by former Bern EVP National Councilor Marianne Streiff-Feller. She argued that many people with a negative asylum decision could not obtain travel documents and therefore could not leave the country. Many countries refused to allow their citizens to re-enter or to issue the documents necessary for travel. Those affected include Tibetans. Most of these people have been living in Switzerland for years and many speak a national language. After a negative asylum decision, they are not allowed to work, are housed in emergency shelters and have to live on emergency aid. The Federal Council should create a one-time opportunity for a residence permit for such persons. Streiff wanted to limit the regularization of these persons to the old asylum regime, as the new procedure prevents the integration of people with a rejected asylum decision due to shorter processing times.
