Athlete Semenya: Public hearing in Strasbourg

The Grand Chamber of the European Court of Human Rights will hold a public hearing in the case of track and field athlete Caster Semenya on May 15. The first instance of the Court found Switzerland guilty of discrimination.
The Confederation has requested that the case be reviewed by the Grand Chamber. The Swiss Federal Supreme Court was the last national instance to deal with the case. Semenya had challenged a 2019 decision by the Court of Arbitration for Sport (CAS) there.
The middle-distance runner from South Africa is defending herself against a regulation of the International Association of Athletics Federations (IAAF). According to the guidelines laid down therein, Semenya would have to lower her natural testosterone level in order to take part in competitions.
Last summer, the first instance of the ECtHR found that Switzerland had violated Article 14 of the European Convention on Human Rights (ECHR) on the prohibition of discrimination in conjunction with Article 8, which protects the right to respect for private life.
After the hearing, the Grand Chamber will withdraw for its deliberations and announce its decision at a date yet to be determined.
