Commission approves partial revision of the Tobacco Products Act

The popular initiative "Children and young people without tobacco advertising", which was approved by voters at the beginning of 2022, is to be implemented. On Friday, the National Council's Social Security and Health Committee approved a corresponding revision of the Tobacco Products Act by 17 votes to 8 - and submitted new proposals in the process.

Two years ago, the people approved the initiative with 56.6 percent of votes in favor. It demanded that "any form of tobacco advertising that is accessible to children should be banned". After the National Council rejected the bill for the first time, the Council of States discussed the text again in the fall session.

The National Council Committee for Social Security and Health (SGK-N) is now proposing to adopt several resolutions of the Council of States, as reported by the parliamentary services on Friday. This concerns in particular the provisions on tobacco advertising in publicly accessible places and the sponsorship of events to which minors have access.

On other points, the Commission has drawn up new compromise proposals that deviate from or clarify the Federal Council's draft and the resolutions of the Council of States. With regard to advertising in print media, the Commission proposes allowing it in the inside section of newspapers that are mainly sold by subscription and whose readership consists of at least 98% adults.

On the subject of advertising restrictions, it proposes allowing sales by mobile vendors in publicly accessible places that can be frequented by minors. But only if it is ensured that the advertising is neither visible nor accessible to minors, according to the press release.

Finally, the Commission also proposes to clarify that the advertising of cigars and cigarillos through tastings and customer promotions is only permitted if it is aimed exclusively at adults.

The business is therefore ready for the winter session.
