Council of States committee does not want to extend tobacco advertising ban

The responsible Council of States committee still does not want to implement the tobacco advertising ban initiative adopted by the people and the cantons word for word. By and large, it is sticking to the previous resolutions of the Council of States.

Parliament is struggling with new restrictions on tobacco advertising. The bill to implement the tobacco advertising ban initiative failed to gain a majority in the National Council in February due to opposition from the SVP, SP and Greens.

The Federal Council wants to implement the initiative with a comprehensive ban on advertising, for tobacco products and also for e-cigarettes. The Council of States weakened the bill last fall - to the displeasure of the left-wing initiators.

The Social and Health Committee of the Council of States (SGK-S) wants to largely maintain the previous resolutions, as announced by the parliamentary services on Friday. In contrast to the National Council, the SGK-S considers the measures adopted by its Council to be in line with the constitution, even if the small chamber does not want to implement the initiative word for word.

For example, the Council of States had enshrined exceptions for mobile sales staff in publicly accessible places and the direct, personal sales promotion of cigars and cigarillos in the law. In addition, tobacco advertising in publicly accessible places and the sponsorship of events should remain permitted, provided that the advertising is neither accessible nor visible to minors.

However, the provisions on tobacco advertising in publicly accessible places and the sponsorship of events that can be attended by minors are to be formulated more clearly. However, the Commission rejected more far-reaching amendments: for example, the Commission does not want to prohibit the personal promotion of cigars and cigarillos in places that can be visited by minors.
